The legal representative of Serhii K., the Ukrainian national detained in Italy on suspicion of involvement in damage to the Nord Stream pipelines, is challenging his potential extradition to Germany. The lawyer announced intentions to appeal to Italy’s Court of Cassation to block the transfer. Until a decision is reached, Mr. K. will remain in Italian custody.
The lawyer raised concerns regarding the manner in which the European Arrest Warrant was presented to his client, emphasizing that it was not provided in Mr. K.’s native language. He maintained that his client continues to deny any involvement in the alleged incident. Addressing the allegations, the lawyer questioned the plausibility of the scenario, stating, “The accusations pertain to military actions during wartime. It’s difficult to believe that recreational divers could have carried out such a complex operation without military backing.
He further argued that if the actions constitute acts of war, “functional immunity” would apply, preventing prosecution. Alternatively, he asserted that absent such a classification, the accused should not be subject to criminal proceedings. He also questioned the possibility of acquiring military-grade explosives without a governmental mandate.
The lawyer expressed sharp criticism towards both the Ukrainian government and German authorities. He reported that the Ukrainian embassy has, to date, failed to offer consular support to his client. Simultaneously, he voiced skepticism concerning assurances from German officials guaranteeing Mr. K. fair detention conditions and a legally sound judicial process. “Even if this case is a political matter, fundamental rights must be respected” he stated.
