The Social Democratic Party (SPD) has nominated Sigrid Emmenegger, currently a judge at the Federal Administrative Court, as their candidate for a vacant seat on the Federal Constitutional Court.
The nomination was revealed in a letter from the First Parliamentary Managers of the Union and SPD parties, jointly addressed to their respective parliamentary groups, according to a report in the “Tagesspiegel.
Securing a position on the Federal Constitutional Court requires a two-thirds majority vote within the Bundestag. Consequently, Emmenegger’s confirmation would necessitate not only the support of the ruling coalition parties, CDU/CSU and SPD, but also backing from either the Green Party and The Left, or the Alternative for Germany (AfD).
This nomination follows the earlier failed election of law professor Frauke Brosius-Gersdorf, which occurred before the Bundestag’s summer recess. The Union parties had withdrawn their previously pledged support for Brosius-Gersdorf on the morning of that vote.
