AfD Loses Battle For Otto Wels Hall In Bundestag After Court Ruling

On Thursday, the Federal Constitutional Court dismissed the AfD faction’s request in the organ‑dispute case concerning the allocation of the Otto‑Wels hall in the Bundestag.

The court ruled that the AfD faction is not entitled to that specific hall. The constitutional status of parliamentary factions does not grant a right to a particular meeting room; the AfD’s claim that, as the second‑largest faction, it should receive the second‑largest hall was deemed unfounded. The organ rights enshrined in the Basic Law secure participation in governmental decision‑making, not “success bonuses”.

The Bundestag’s Senior Council’s decision to allocate two alternative halls to the AfD was justified and does not violate equal‑treatment principles. An allocation strictly based on faction size is unnecessary for equal participation. The assigned hall is deemed suitable for the AfD’s size, and there is no evidence of an “evidently unlawful, arbitrary” decision.
