Academic Slams Brosius-Gersdorf Row

The debate surrounding the proposed Federal Constitutional Court candidate, Frauke Brosius-Gersdorf, has drawn sharp criticism from Alexander Thiele, Professor of Public Law at the BSP Business & Law School in Berlin. In an interview with the ARD Tagestheumen on Tuesday, Thiele questioned the handling of a nominee who “did not apply for the position herself, but was requested by the political parties.

He expressed concern over what he described as the deliberate discrediting and public harassment of Brosius-Gersdorf, suggesting she had not received adequate protection from the political sphere. Thiele specifically addressed accusations of left-wing activism, which he argued had escalated into assertions that she is unsuitable, undemocratic and a threat to the constitutional order. He stated a firm rejection of such claims.

Thiele emphasized the inherently political nature of constitutional law, asserting, “The entirety of constitutional law is political”. His comments reflect a broader discussion regarding the scrutiny and vetting process of nominees for high judicial positions within Germany.
