German Court Chief Warns of Approval Chaos

German Administrative Court President Andreas Korbmacher Urges Swift Action on EU Emergency Regulation Successor

The President of the German Administrative Court, Andreas Korbmacher, has emphasized the need for a swift solution to the EU’s emergency regulation, which is set to expire on June 30, to simplify the approval process for renewable energy projects. The regulation, which has been in effect since the pandemic, has significantly reduced the time required for the approval process.

In an interview with the Handelsblatt, Korbmacher expressed hope that the German parliament would quickly implement the successor regulation. He noted that the draft is already available, having been initially proposed by the Ampel coalition, but failed to pass due to the coalition’s collapse and therefore needs to be reintroduced.

Korbmacher warned that the lack of a successor regulation would result in a two-tiered approval system, with projects submitted before June 30, 2025, benefiting from the existing regulations, while those submitted later would face a more complex and time-consuming process. He described this situation as “not a good state of affairs.
