The Frankfurt Higher Regional Court rejected a request for a judicial review connected to a deadly special police unit (SEK) operation in the Frankfurt train‑station area. On Tuesday, the court announced that its 7th criminal senate had finally decided on the claims‑facing procedure regarding the police action in August 2022.
The incident involved the victim’s brother, who was killed by a gunshot fired by an SEK officer. According to police reports, the man had entered a hotel room in a drunken state, threatening two prostitutes and armed with a knife and a so‑called pistol. After a fierce confrontation, the officer discharged his weapon, killing the brother.
The Frankfurt public prosecutor, after extensive investigations, had closed the case against the officer, concluding that the shooting was justified as a defense of necessity. The deceased’s brother challenged this dismissal, questioning the alleged knife attack. He argued that the fatal shots were fired even though the victim was already lying on the floor.
The higher court found no errors in the prosecutor’s investigation and dismissed the appeal. The ruling is final and cannot be appealed.
