Union Official Admits Errors in Judge Dispute

A leading figure within Germany’s CDU/CSU parliamentary group has acknowledged shortcomings in the handling of the recent nomination process for a Federal Constitutional Court judge, while maintaining that the root of the dispute lies with the Social Democrats (SPD).

Steffen Bilger, First Parliamentary Managing Director of the CDU/CSU, stated on Friday that the process “did not run well” and conceded that errors were made. He explained that, in retrospect, the SPD’s initial proposal proved divisive and the coalition failed to adequately address the resulting tensions. This led to a challenging situation for the governing partnership.

Bilger expressed understanding regarding the SPD’s dissatisfaction with the proceedings, acknowledging that the situation continues to place strain on the coalition. However, he indicated that constructive dialogue has resumed between the governing parties and a resolution is anticipated. He emphasized the importance of regaining the positive momentum experienced during the initial weeks of the coalition government.

Following the withdrawal of jurist Frauke Brosius-Gersdorf as a candidate for the constitutional court, the Left Party is now asserting its claim to nominate a candidate. Party co-leader Ines Schwerdtner stated that, given the current balance of power in the Bundestag, the Left Party is entitled to propose a nominee and intends to do so.

The coalition now faces questions regarding suitable candidates and how to secure the necessary two-thirds majority in the Bundestag. Schwerdtner did not rule out the possibility of the CDU/CSU again seeking support from the AfD party to pass legislation. She suggested that elements within the CDU/CSU appear to be actively engaging in a “culture war” on the right.

Schwerdtner characterized the withdrawal of the candidate as a significant setback for the coalition, highlighting what she perceived as a lack of internal discipline within the governing parties. She suggested the SPD lacks the necessary assertiveness to effectively govern, adding that the current situation is incomprehensible to citizens facing pressing issues.
