The nomination of Frauke Brosius-Gersdorf as a candidate for the Federal Constitutional Court is facing increasing challenges, according to Bavarian State Premier Markus Söder. Söder, speaking in a recent podcast interview, suggested that the Social Democratic Party (SPD) should reconsider their proposal, as support within the conservative bloc is waning.
While acknowledging Brosius-Gersdorf’s substantial legal expertise, Söder indicated that her candidacy is unlikely to secure the necessary majority. He characterized the situation as resulting in a perception of bias surrounding the nomination, which could potentially compromise the impartiality of the Constitutional Court.
The coalition partners have until after the summer recess to resolve the selection process. Söder emphasized that the Federal Constitutional Court remains fully functional and urged a period of reflection and cooling off before renewed attempts are made to reach a consensus. He advocated for a pragmatic approach, suggesting a direct confrontation would ultimately prove unproductive.
