Private Landlords Fear Rent Cap Will Overwhelm Small Landowners

The German Real Estate Owner Association, Haus & Grund, has expressed concerns that private small landlords are being unfairly treated and overwhelmed by the proposed legislation of the federal government. According to Kai Warnecke, President of Haus & Grund, the limits of affordability for private landlords have been exceeded. “In contrast to real estate corporations, private individuals cannot compensate or transfer the significantly increased costs of rental management” Warnecke told the “Spiegel.”

Private individuals play a crucial role in fair and amicable coexistence with their tenants. “This must finally be recognized by politics: we need a new law for private landlords” said Warnecke. In fact, 60% of all rental apartments in Germany are provided by private small landlords rather than large corporations.

Warnecke warns that these individuals may withdraw from the rental housing market if the government imposes strict regulations. “This would ultimately encourage the sale of apartments to real estate speculators and further worsen the situation.” From Warnecke’s perspective, private landlords should be exempt from further regulations.

This includes extending the rent cap and potentially limiting the modernization surcharge, which currently allows landlords to transfer eight percent of the renovation costs to the annual rent. Private landlords argue that these measures would make it even more difficult for them to manage their properties, potentially leading to a lack of affordable housing options for tenants. The association is calling for a comprehensive review of the proposed legislation to ensure that the needs and concerns of private small landlords are addressed. They believe that a fair and sustainable housing market can only be achieved by considering the perspectives of all stakeholders, including private landlords.
