No Charges Filed Against Former Prosecutor in Cum-Ex Scandal

Following a comprehensive review of a criminal complaint, German prosecutors have decided against launching a formal investigation into former senior public prosecutor Anne Brorhilker regarding her handling of investigations related to the “Cum-Ex” financial transactions.

The complaint was filed last autumn by legal representatives of Christian Olearius, the former CEO of Warburg Bank. They alleged that Brorhilker intentionally presented incomplete and inaccurate information as the basis for charges against former Warburg Bank employees involved in the Cum-Ex dealings.

A spokesperson for the Bonn prosecutor’s office stated that the review found no initial suspicion of criminal conduct warranting a formal investigation, as reported in Friday’s edition of the “Kölnische Rundschau” newspaper.

Sources within the judicial system indicate that a complaint has been lodged with the Cologne Public Prosecutor General’s Office regarding the decision not to proceed with a criminal investigation. However, a spokesperson for the Cologne office was initially unable to confirm this information on Thursday.

Brorhilker previously led Cum-Ex investigations at the Cologne Public Prosecutor’s Office, bringing charges against numerous individuals allegedly involved in the complex tax avoidance schemes. She resigned from her position earlier this year, citing a lack of sufficient support for the demanding work. She has since taken up a role in the management of the “Finanzwende” (Financial Transition) citizens’ movement.
