The German Federal Ministry of Justice has proposed sweeping legislative changes targeting the deliberate use of incapacitating substances, like date-rape drugs, in crimes such as sexual assault and robbery, potentially leading to a minimum prison sentence of five years. The draft law, released Monday, seeks to address a loophole exposed by a recent ruling from the Federal Court of Justice.
Currently, while the covert administration of such substances can be considered an aggravating factor in sentencing, the Federal Court of Justice controversially determined last year that they do not qualify as “dangerous implements” under German criminal code. This classification had previously limited the minimum sentence to three years. The proposed legislation aims to circumvent this technicality and ensure significantly harsher penalties for offenders.
Justice Minister Stefanie Hubig underscored the gravity of the issue, stating that perpetrators employing incapacitating substances exhibit a “particularly perfidious and dangerous” modus operandi, rendering their victims defenseless and exploiting their vulnerability. Hubig acknowledged that these crimes are occurring within Germany, highlighting instances of women being deliberately targeted with chemicals to facilitate sexual violence. She characterized the need for a robust response, insisting that these actions must be unequivocally condemned through stringent legal repercussions.
The draft law has now been disseminated to German states and professional organizations for review, with a public consultation period extending until December 19, 2025. All submitted feedback and responses from relevant bodies will be published online.
