The background is that Dobrindt linked the intensified border controls he ordered to the emergency clause under Article 72 of the EU Treaty, which allows for exceptions to the applicable law for “maintaining public order and internal security.” Following this, Federal Chancellor Friedrich Merz (CDU) clarified after discussions with Vice Chancellor Lars Klingbeil (SPD) that “no national emergency” had been declared.
