Germany to Simplify Lease Termination for Domestic Violence Victims

In a move aimed at providing a smoother exit for victims of domestic violence from shared rental agreements, several state justice ministers are set to propose a new policy at the upcoming justice minister conference. According to a report by Bild, Hamburg’s Justice Senator Anna Gallina, a Green Party member, will put forward a draft resolution for consideration.

The proposed resolution seeks to make it easier for victims of domestic violence to obtain the consent of their co-tenants to terminate a joint tenancy agreement. This would involve the federal Ministry of Justice, led by Minister Stefanie Hubig of the Social Democratic Party, drafting a new law to achieve this goal.

The German Lawyers’ Association has expressed support for the initiative, with its president, Stefan von Raumer, stating that a simplified regulation would be desirable, allowing many affected individuals to facilitate a fresh start. Von Raumer emphasized the importance of balancing the interests of both the victims and the landlords in the process, noting that it is crucial for victims to be able to exit the shared living arrangement with the perpetrator as quickly and with minimal legal disputes and financial burdens as possible.
