The rise in antisemitic incidents across Germany since October 7th, 2023, is prompting calls for a significant overhaul of existing legislation. Felix Klein, the Federal Government’s Commissioner for Jewish Affairs, has urged lawmakers to enact a swift and appropriate response to the escalating problem, citing a dramatic increase in hate crimes and online harassment.
Klein’s appeal centers on a proposed reform of Section 130 of the Criminal Code, which currently addresses incitement to hatred. He argues that explicitly outlawing antisemitic and racist incitement is now essential, suggesting the existing framework is insufficient to address the current climate. Adding further impetus to the calls for stricter measures, Federal Minister for Family Affairs, Karin Prien, has voiced support for amending the General Act on Equal Treatment (AGG). Speaking in a recent podcast, she indicated a willingness to consider criminal penalties in cases of antisemitic discrimination within private legal matters, a deviation from previous reluctance to expand the scope of legal repercussions.
“It cannot be tolerated in Germany that people are discriminated against simply because they are Jewish” Minister Prien stated, reflecting a sentiment prevalent amongst policymakers increasingly concerned about the normalization of antisemitic rhetoric and behavior. The potential alteration of the AGG, alongside reforms to the Criminal Code, signals a growing recognition within the German government that existing protections are inadequate to safeguard Jewish communities and address the escalating threat of antisemitism.
