Evidence Needed for Constitutional Court Evaluation

In the debate over an AfD ban, the Justiciar of the Union faction, Ansgar Heveling (CDU), calls for restraint. Heveling told the “Rheinische Post” (Monday) that the classification of the party as securely right-extremist by the constitutional protection agency is “initially an official assessment. The Basic Law has deliberately decided not to allow party bans solely based on executive decisions.” Therefore, the assessment of the constitutional protection agency is “an indication of a violation of the constitution by the AfD, but the constitutional court’s assessment criterion goes beyond that. It requires evidence of actively wanting to destroy the constitutional order.” Heveling further stated: Considering the development of the AfD, “it is not surprising that the constitutional protection agency has now come to the conclusion that the entire party should be classified as right-extremist.
