Conservative Lawmaker Attacks Miersch Ally

A prominent member of the Christian Democratic Union (CDU) is raising concerns regarding the potential renomination of legal expert Frauke Brosius-Gersdorf as a judge on Germany’s Federal Constitutional Court. Saskia Ludwig, a member of the Bundestag, voiced her reservations in an interview with “Der Stern”, questioning the suitability of Brosius-Gersdorf for the position and initiating a debate about the process for selecting judges.

Ludwig’s remarks specifically questioned why Brosius-Gersdorf did not withdraw her candidacy prior to the scheduled election date, given what she described as the predictable outcome. She expressed concerns that the individual’s alignment with specific viewpoints, characterizing them as “left-leaning fundamentalists” would render them unsuitable, particularly for those from eastern Germany.

Beyond the individual nomination, Ludwig has also called for a reform of the procedure used for selecting Constitutional Court judges. She argues that the current formula, implemented in 2018, which allocates three positions to the Social Democratic Party (SPD), one each to the Green Party and the Free Democratic Party (FDP), no longer reflects societal representation. Ludwig questioned the rationale behind allowing individuals, specifically mentioning Herr Miersch, to share influence, allocating a total of four judicial positions alongside those holding perspectives considered radical or left-leaning within both the Green and broader left-wing political spectrum. The call for reform aims to ensure a more balanced and representative selection process for this crucial judicial body.
