German Court Ruling on Border Rejections Sparks Concern in Berlin

In the wake of a recent Berlin Administrative Court decision, the Social Democratic Party’s parliamentary group has expressed caution and concern over the implications of the ruling. Matthias Miersch, the SPD’s faction leader, emphasized the significance of the court’s decision, which deemed the rejection of three Somalis by the federal police to be unlawful.

While acknowledging the gravity of the ruling, Miersch emphasized that it is not a final, definitive judgment. He noted, however, that the decision must be taken seriously and could potentially limit the government’s ability to act. Miersch suggested that the government should now carefully assess the implications of the ruling, in consultation with the Ministry of the Interior and other relevant stakeholders.

The SPD leader stressed the need for a thorough evaluation to ensure the maintenance of legal certainty, as the party cannot afford to have these issues played out on the backs of the police.
