The judge overseeing the acquisition dispute between Elon Musk and Twitter on Thursday decided to put legal proceedings on hold until October 28 following a request by the Tesla CEO, meaning the trial which was scheduled to start on October 17 will not take place as planned.
Twitter had opposed Musk’s motion to stay proceedings and had raised concerns that he might not follow through on his words to close the deal quickly.
“If the transaction is not closed by 5:00 p.m. (local time) on October 28, 2022, the parties are directed to contact each other during the evening by email to obtain hearing dates for November 2022,” the court judge said in her order. of Delaware Chancery, Kathaleen McCormick.
Elon Musk’s lawyers on Thursday filed a motion to stay legal proceedings in his dispute with Twitter, and to have the trial set to begin on October 17 removed from the court’s calendar, citing “changed circumstances that have effectively instigated this action”, this according to the deposition made in court.
The filing – which says the suspension is “pending the closing of the transaction” – comes after earlier this week Musk had proposed to proceed with the purchase of Twitter at a price of 44.8 billion euros under the terms originally agreed, after he had spent many months trying to break the deal.
